regional wrap-up Ex-lawyer Power gets 18 months 14-year-old client has been sentenced to 18 months in jail and two years pro- bation. Earlier this year, B.C. Supreme H Court Justice Catherine Wedge found Power guilty, although at that time, only the New Westminster lawyer's ini- tials were being used in court docu- ments. Media criticized the Law Society of British Columbia for not publishing the lawyer's name after the conviction, even though a court order was still in place prohibiting the release. It was eventually lifted and the lawyer's name released. The LSBC disbarred Power earlier this year after an investigation revealed arold Garrett Power, 53, the for- mer B.C. lawyer who was found guilty of sexually exploiting a he had lied on an application form and had been charged under another name with a sex crime against two youths in Ontario. He was acquitted on those charges and later moved to B.C. using the name Power. Power was abandoned by unwed par- ents in a Maritime orphanage, but was later cared for by an aunt and uncle who gave him their surname McGory, but did not legally change his birth mother's name. He became known as Gary Joseph McGory until his early 30s when he learned of his real parents and then acquired a birth certificate in the name of Harold Garrett Power. Subsequently he used the name Power for some pur- poses and McGory for others. He used Power on a declaration of bankruptcy in 1990 and when attending the University of Western Ontario. When arrested in Toronto and charged with five counts under s. 212 (4) of the Criminal Code of Canada with obtaining, for consid- eration, the sexual services of a person under 18 years of age, he used the name McGory and did not advise police or Crown counsel that his legal name was Power. He graduated law school from the University of Toronto in 1997 under the name Power and a year later in April 1998 was acquitted of the charges under the name McGory. In the application form to the LSBC, Power did not indi- cate he had been charged. The issue came to light after police began investigating Power for sexual exploitation in B.C. — JS Business disputes mediated by an experienced CA Helping you get better results for your clients BACHELOR OF APPLIED ARTS As a chartered accountant with more than three decades of experience consulting on complex business matters, Joel Cohen can help mediate fair and effective resolutions to numerous complex business disputes. t: 416.932.6216 | e: jcohen@rsmrichter.com www.rsmrichter.com Toronto | Montreal | Calgary RSM Richter is an independent member rm of RSM International, an afliation of independent accounting and consulting rms. 12 NO VEMBER / DECEMBER 2009 www.
