Court of Appeal has launched a pilot proj- ect that would see no more than a year between the time the notice of appeal is filed to the hearing date. Chief Justice Lance Finch says the B project will run from Sept. 7, 2010, to Dec. 30, 2011. It was structured with input from representatives of the federal and provincial Crown, defence counsel, and the Legal Services Society. "This pilot project does not apply to appeals against sentence, only to forfeiture appeals or to appeals concerning extradition and inter- national mutual assistance," Finch said in his directive. It sets out a structured timeline for each stage of the process that lawyers making appeals will have to follow. "The pilot project involves: (a) new time limits for the filing of all appeal documents, (b) setting appeal hearing date early in the appellate process, and (c) imposing a mandatory 'compliance hearing' 9 weeks after filing of the notice of appeal to moni- tor and ensure compliance with dead- lines," the directive points out. However, some flexibility will be allowed. The directive states when an individual is being held in custody, the timeline can be shortened. There may be "exceptional cases" when it "may not be realistic" and longer periods are needed.
