government is trying to do, and con- sider that Canadian criminal justice is not entirely based on rehabilitation. "There are other possible objectives in laws," says the Vancouver-based crimi- nal defence lawyer. "That is simply, for example, Canadian law recognizes that denunciation is a legitimate goal of sentencing." He suggests the very goal of tough- on-crime rules may be to produce stiffer penalties. "It is conceivable that a law which increases penalties is designed to address denunciation and whether or not it will reduce crime is only of a sec- ondary concern, with the primary con- cern simply being that certain kinds of crimes need to receive more severe pen- alties than currently being imposed." When it comes to the idea of denun- ciation, Wachowich also believes it has a valid place in Canadian law, but says that is something judges are already aware of.
