Court-induced actions are emotionally and financially draining and lead to less than perfect solutions for both parties. "Why don't we build a settlement-based process as opposed to one that is run by the rules of the court? There are legal issues and those are the only issues that we need to pay attention to but what is important is that each person gets what they need in the resolution," says Cameron. Cameron estimates since 2001, there have been more than 700 B.C. lawyers trained in the collaborative law process. But for devotees such as Cameron, it is the new breed of family law lawyers emerging from law schools that excites her. "For the first time, we are seeing a wave of younger lawyers who never wanted to litigate and are committed to helping family in other ways," she says. One is Catherine Brinkman, who graduated from the University of British Columbia with a psychology degree and heard about collaborative law. It drew her into UBC's law program but she had no intention of litigating, although she did it during her articles. Her focus was really pushing deeper into family collaborative law and mediating out- comes. She joined a partner with simi- lar interests (but who also offers the ability to handle litigation cases) to form Harbour Family Law a few years ago. She made a conscious decision not to litigate. "I have the ability to choose my clients and practise all out of court and that is a little tougher to do in a larger firm," she says. Brinkman also feels she is part of a new style of family lawyer emerg- ing in her peers. "I especially see it in law school students and those starting practicing. The idea of litigating fam- ily matters is not nearly as attractive and professionally satisfying as help- ing people settle without creating more conflict." She says she feels the personal impact of doing collaborative or media- tion work rather than court conflicts.
