"We're still dealing with the repercussions of the G20 in Canada and repercussions of student protests in Montreal and the proposed Quebec charter of values as well as wearing of the Niqab in the courtroom," she says. Add to that list issues such as con- sidering what is the test of extradition, and what has to be shown for the extradition judge to consider the extradition test has been made? "What sort of examination of evidence did the extradition judge engage in particularly to determine whether or not information procured by torture might form the basis of it and are you extraditing someone to a fair trial or are you not?" When asked about her feelings regard- ing Trinity Western University's proposed school of law with its same-sex prohibition, Pillay says the CCLA is "still formulating its response" but says it's an example of rights being pitched against each other in the larger arena of fundamental freedoms. "With Trinity Western, I think the true rights we see engaged there are freedom of religion and equality — I don't want to get into the merits of it but in that issue you have freedom of religion rights that enable private institutions to carry forward sincerely held beliefs and we also see the rights of equality being engaged." The CCLA is also very focused on issues of fair trial rights and due process to make sure they are in place across the board. "There is a concern about a rise of detention outside the criminal justice process that we've witnessed in Canada through administrative detention or immi- gration. We're also concerned about incur- sions into refugee rights and the conflat- ing of refugees with human smugglers." Accountability in policing is an area Pillay says she feels requires constant vigilance — when it comes to the right to protest, police not only have a duty to allow pro- tests to take place and protect protestors and the crowd, but they also have a duty to facilitate that protest as it is a constitution- ally protected right and part of freedom of expression and speech. The CCLA has also joined forces with an international network of civil liberties organizations including the American Civil Liberties Union and those from the U.K., Israel, Egypt, Argentina, and South Africa to look comparatively at policing and pro- tests. "We no longer work in isolation and upholding liberties in Canada is important but it is also important in ensuring the commitment to these issues that there is a ripple effect and it's important for Canada to do its part," says Pillay. Of course a large part of Pillay's job with the CCLA is working closely with leading lawyers and firms in Canada to assist in finding the right representation for cases on a pro bono basis, often ones that are groundbreaking. "We seek intervention based on arguments in the public interest but also having a unique and distinct per- spective and we rely as well on the support of pro bono counsel and we have an excel- lent roster across the country. Often they seek us out," she says. The CCLA relies on a circle of key partners.
