CANAdA LAW BooK® 12 October 2013 www.CANADIAN L a w ye r m a g . c o m children of the murdered and missing women to seek civil remedy. Nine claims representing 14 children have been filed in B.C. Supreme Court, said Vancouver lawyer Jason Gratl, who along with co-counsel Neil Chantler is representing the claimants now suing Pickton, brother David Pickton, the Vancouver Police Department, Crown prosecutors, the B.C. government, and the RCMP. "We were both involved in the Missing Women's Inquiry and that is the only reason we are equipped to do this. Without that background, we wouldn't be in a position to represent these children of the murdered women," said Gratl, who served as independent counsel to the inquiry while Chantler was associate counsel, representing 25 families of missing women, many of whom were sex trade workers. Gratl said each claim varies "which is why we didn't go as a class action" but the rationale behind the suits is the children have suffered some loss through negligence or actions of the defendants. "There are many defendants and the civil claim to each defendant differs," he said, adding a case management hearing has already indicated one judge will hear all nine claims. "In the criminal trial neither Robert Pickton nor David Pickton testified," said Gratl. "Robert Pickton could not be compelled to testify while the Crown decided not to have David Pickton testify. In civil matters, it is quite different." Gratl said both the Pickton brothers could be called to testify. Gratl said Robert Pickton is being sued for the financial and emotional loss of a parent suffered by the children. Pickton is currently serving a 25-year sentence after his December 2007 conviction on six counts of second-degree murder involving Brenda Wolfe, Marnie Frey, Georgina Papin, Mona Wilson, Sereena Abotsway, and Andrea
