Doroshenko served Ojanen with her termination letter while she was attending a professional legal training course class, a "deliberately public firing" that was "unnecessary and psychologically brutal," wrote Gomery, who added that Acumen and Doroshenko "have persisted in unfounded allegations" three years later, making Ojanen unemployable in the legal profession. "She is the victim of unfair, bullying, bad-faith conduct by her former employer and her former principal and has suffered substan- tial and prolonged emotional distress because of that conduct," said the decision. Ojanen's alleged misconduct included being in the office after hours without permis- sion, missing a court appearance, "disloyal and trouble-making" behaviour, insubordin- ation, refusing a direction to attend counsel- ling, "avoiding responsibility," showing she was "unfit to practice law," taking client files home and creating a blog to compete with Acumen and allowing her husband access to privileged materials. "I have had great feedback from my students about their articling experience. Many of them have remained with my office and are still here today," Doroshenko says. But I recall one file where the deal didn't come together, for all the right reasons, and while it was a very difficult file, I know that it was the right result." They've got a very solid national TMT group — technology, media, telecommunications — good depth in intellectual property and privacy, real focus on startup and scale-up communities in each of the jurisdictions they work in, leadership in large enterprise outsourcing and cloud computing and good tie-in to international support. So how was your time at Norton Rose? And why did you make the move? It is a terrific firm and I enjoyed many good years there. At Fasken, there is need for what is an expanding practice in the TMT space nationally and for the Calgary office as it continues to grow. I see some good opportunities and prospects down the road. And as Calgary's economy evolves, as well, it seemed like a good fit for what it is that I want to do. What are the big issues in tech and privacy law you expect to tackle at Fasken? Alberta has really been at the forefront of the legislated obligation to report to the applicable privacy commissioner and to individuals. There would be good support for continuing that work as those obligations have been picked up under PIPEDA and other legislation. The legislation will continue to evolve to be more sophisticated for protection of personal information, pushed forward by other international standards that are constantly changing.
